VERNAL — An alcohol-restricted driver was arrested over the weekend after police said he had a blood-alcohol level over seven times the legal limit.
Marty Brian Burr, 33, was booked into the Uintah County Jail for investigation of negligently operating a vehicle while having prior DUI convictions.
A Uintah County sheriff's deputy was traveling near 1500 East and 1500 South on Sunday night when Burr approached him from behind at a high rate of speed and was having trouble staying in his lane, according to a police booking affidavit.
"I allowed Marty to pass me and began to follow his vehicle," the deputy wrote in the affidavit before pulling him over for a traffic violation.
"I could smell the strong odor of an alcoholic beverage emanating from Marty when he spoke. He spoke with a slow and slurred speech. When I asked for a driver's license, Marty spent several seconds going through his pockets … before saying he couldn't locate his wallet," according to the affidavit.
Burr allegedly told the deputy he drank two beers. But while at the hospital to be checked out before being booked into jail, "Marty admitted to drinking about half a gallon of whiskey," the affidavit states.
His blood-alcohol level was measured at 0.351%, according to the affidavit.
